Legal Authority & Acknowledgments
Post-Probate Authority
The P.J.M. Estate & Trust operates under post-probate finality, meaning all probate matters have been settled and the estate now operates under private law. The Executor maintains all rights, powers, and authorities granted under New York Estates, Powers and Trusts Law (EPTL), including but not limited to the exercise of fiduciary powers and the administration of trust assets.
Holder in Due Course
Per UCC § 3-302, the Trust holds superior title as a holder in due course, free of personal defenses and claims. This perfected status establishes exclusive ownership rights that cannot be diminished by third-party claims or administrative interference.
Private Office Paramount
The Executor's Office operates as a Private Office Paramount, meaning it is not subject to public administration or oversight. Public servants and agencies have no authority to administer matters within the settled estate's jurisdiction. Any interference with perfected private settlement interests constitutes a breach triggering personal liability.
Four Corners Rule
All matters governed by the settlement agreement and trust instruments are interpreted strictly within the four corners of those documents. Only recited facts govern — extrinsic evidence or third-party claims do not modify the terms or affect the perfected interests established therein.
